Lessons from Losses 4/2009. For professionals, electrical safety usually means the prevention of electric shock and electric arc accidents. However, electrical fires cause more deaths. Last year in Finland, one person died in an electrical accident but several people were killed in electric fires. Of those killed by construction fires, 20% died in fires caused by electricity.

Liability Newsletter 1/2009. Since 1988, patient claims have been assessed under two different sets of regulations. If the injury was caused in a public hospital, the claim was assessed and settled under the rules for the provisional order on patient claims payments. This was a public order based on specified responsibility, and administered by the Norwegian System of Compensation to Patients (NPE). However, claims arising in the private health sector were assessed and settled under general payment laws, and were handled by professional liability insurance in private insurance companies. The intention of introducing new patient claims legislation was that all patient claims should be handled under the same regulatory framework irrespective of the health sector in which the claim arose. So far, the legislation has been applied only in the public health sector, where claims are paid by the public and administered by the NPE, but, from 1 January 2009, it will also apply to the private health sector.

Dersom skaden var forårsaket ved offentlig sykehus, ble skaden vurdert og oppgjort iht. regler for midlertidig ordning med pasientskadeerstatning. Dette var en offentlig ordning som hadde objektivisert ansvar som grunnlag, og som ble administrert av Norsk Pasientskadeerstatning. Skader forvoldt i det private helsevesen ble derimot vurdert og oppgjort etter alminnelig erstatningsrett, og avgjort av yrkesutøverens ansvarsforsikring i privat forsikringsselskap. Intensjonen med å innføre en ny pasientskadelov var at alle pasientskader skulle behandles etter det samme regelverk uansett hvor i helsevesenet skaden oppsto. Til nå har loven bare vært satt i kraft for det offentlige helsevesen, hvor skadene betales av det offentlige og administreres av Norsk Pasientskadeerstatning; men fra 1. januar 2009 gjelder loven også for det private helsevesen.
